These Terms of Service govern your use of the CASH28 online store and any purchase made through it. The store is operated by CASH28 LTD (“CASH28”, “we”, “us” or “our”).

By accessing our website or placing an order, you agree to these Terms. Please read them alongside our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

Our online store is hosted by Shopify, which provides the ecommerce platform through which our products are offered.

2. Using our website

You may use our website only for lawful purposes. You must not:

• Use the website for fraudulent, abusive or unlawful activity

• Attempt to gain unauthorised access to the website or another customer’s account

• Introduce viruses, malicious code or other harmful technology

• Scrape, copy or commercially exploit our website without permission

• Interfere with the security or operation of the store

You must be at least 18 years old to place an order, or have permission from a parent or legal guardian.

3. Product information

We take reasonable care to ensure that product descriptions, photographs, colours, measurements and prices are accurate.

Colours may appear slightly different depending on your screen settings, lighting and the garment-production process. Minor variations that do not materially affect the product are not considered defects. Nothing in this section limits your rights where an item is faulty, damaged, misdescribed or not of satisfactory quality.

4. Product availability

All products are subject to availability. Adding an item to your basket does not reserve it.

We may limit quantities, discontinue a product or remove an item from sale. If an item becomes unavailable after you place an order, we will contact you and provide a refund for the unavailable item.

5. Prices and payment

Prices are displayed in British pounds unless a different currency is shown for your market.

Any applicable taxes, duties, delivery upgrades or other charges will be displayed at checkout where Shopify is able to calculate them. You are responsible for reviewing the total cost before completing your purchase.

Payment must be authorised before an order can be accepted. We may cancel or decline an order if payment is refused, reversed or identified as potentially fraudulent.

We reserve the right to correct genuine pricing or listing errors. If an error affects an order you have already placed, we will contact you before proceeding and give you the option to accept the corrected price or receive a full refund.

6. Order acceptance

After placing an order, you will receive an order confirmation. This confirms that we have received your order but does not necessarily mean it has been accepted.

A contract is formed when we accept and begin processing the order or send confirmation that it has been dispatched.

We may refuse or cancel an order for legitimate reasons, including:

• Product unavailability

• Incorrect pricing or product information

• Payment or fraud concerns

• Suspected resale, misuse or abuse of a promotion

• An inability to deliver to the address supplied

If we cancel an order after payment has been taken, the affected amount will be refunded.

7. Buy 2 Get 1 Free promotion

Where the Buy 2 Get 1 Free promotion is active:

• Three eligible items must be added to the basket

• The least expensive eligible item will be discounted to £0

• The offer applies only to products included in the advertised promotion

• The promotion is applied automatically at checkout

• The offer cannot be exchanged for cash or account credit

• Returns may cause the promotion and refund amount to be recalculated

• A free item has no separate cash refund value

Unless stated otherwise, the offer may repeat when additional qualifying groups of three eligible items are added to the same order.

We may amend, suspend or withdraw a promotion at any time. This will not affect a qualifying order that we have already accepted.

8. Shipping and delivery

Orders may be produced and dispatched by an approved third-party fulfilment partner.

Free standard shipping is available to supported destinations where the free-shipping rate appears at checkout. “Worldwide” shipping refers to destinations supported by our fulfilment and carrier network and does not guarantee delivery to every country, territory or address.

Any express or upgraded delivery service will be charged separately where available.

Delivery dates are estimates rather than guarantees. Delays may occur because of customs, carriers, severe weather, public holidays, incorrect address details or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error. We cannot guarantee that an address can be changed once production or dispatch has begun.

International customers may be responsible for customs duties, import taxes or local handling charges unless checkout expressly states that these charges are included.

9. Returns, refunds and cancellations

Eligible items may be returned in accordance with our Returns & Refunds Policy.

Our voluntary return conditions do not limit your statutory rights, including your rights where goods are faulty, damaged, misdescribed or not of satisfactory quality.

Where statutory cancellation rights apply, you may notify us within 14 days of receiving your order and return the goods within a further 14 days. Exceptions may apply to products that are genuinely personalised or made to your individual specification.

10. Accounts and customer information

If you create an account, you are responsible for keeping your login details secure and for activity carried out through your account.

You must provide accurate and current contact, billing and delivery information. Please notify us promptly if you believe your account has been accessed without permission.

11. Intellectual property

The CASH28 name, branding, logos, garment artwork, graphics, photographs, website content and other creative material are owned by or licensed to CASH28 LTD.

You may view and use the website for personal, non-commercial shopping purposes. You may not reproduce, modify, distribute, sell or commercially exploit our intellectual property without prior written permission.

Purchasing a product does not transfer ownership of the artwork, branding or other intellectual-property rights displayed on that product.

12. Reviews and submitted content

If you submit a review, photograph, comment or other content, you confirm that:

• You created it or have permission to share it

• It is accurate and not misleading

• It does not violate another person’s rights

• It is not unlawful, abusive, discriminatory or malicious

You grant CASH28 a non-exclusive, worldwide, royalty-free licence to display and use that content in connection with our store and marketing. We may remove submitted content that breaches these Terms.

13. Third-party services and links

Our store may use services provided by Shopify, payment processors, fulfilment partners, delivery companies and other third parties.

Third-party websites and services may operate under their own terms and privacy policies. We are not responsible for content or services controlled independently by those third parties, except where responsibility cannot legally be excluded.

14. Website availability

We aim to keep the store accurate, secure and available, but we cannot guarantee uninterrupted or error-free access.

We may update, suspend or withdraw part of the website for maintenance, security or operational reasons. We will take reasonable steps to minimise disruption where possible.

15. Our responsibility to you

We do not exclude or limit liability where doing so would be unlawful, including liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

• Defective products where liability cannot legally be excluded

• Breach of your statutory consumer rights

Subject to the above, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses arising from a purchase made as a consumer.

Nothing in these Terms affects rights granted to you by applicable consumer law.

16. Events outside our control

We will not be responsible for delay or failure caused by circumstances beyond our reasonable control, including carrier disruption, customs delays, natural disasters, industrial action, government restrictions, internet outages or failures affecting essential third-party services.

This does not affect your statutory rights or our obligation to provide an appropriate remedy where required by law.

17. Changes to these Terms

We may update these Terms to reflect changes to our products, services, operations or legal obligations.

The Terms displayed when your order is accepted will normally apply to that purchase. Updated Terms will apply to future use of the website from the date they are published.

18. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining sections will continue to apply.

19. No waiver

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

20. Governing law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, except that consumers living elsewhere may retain the right to bring proceedings in their local courts where mandatory consumer law permits.
